(function of Terms and Condition) These Terms and Conditions define the rules, scope and provisions for using the websites at the following addresses: www.kanlux.pl, b2b.kanlux.pl , shop.kanlux.pl oraz www.kanlux.com, hereinafter referred to as "Kanlux Websites".
(your use of the Websites is considered as accepting the Terms and Conditions) Use of the Kanlux Websites by any User means that the User has read and understood these Terms and Conditions and agrees to abide by them as well as to act in accordance with applicable law, in particular concerning personal rights, industrial property and copyrights. Lack of consent to the provisions of the Terms and Conditions makes it impossible to use the Kanlux Websites.
(owner of the Websites) Kanlux Websites are operated by Kanlux SA with its registered office in Radzionków, 41-922, ul. Objazdowa 1-3, entered in the register of entrepreneurs kept at the District Court in Gliwice, Commercial Division of the National Court Register under KRS No. 0000163575.
(access restriction) Kanlux SA reserves the right to limit, suspend or close access to the Kanlux Websitesat any time and for any period of time, in whole or in part, for individual or all Users, at its own discretion and without giving any reason.
(no quality guarantee) Kanlux SA does not provide any guarantee for Kanlux Websites concerning the quality of their transmission and reception.
(personal use, legal protection) Content of Kanlux Websites including materials presented on the Kanlux Websites are the property of Kanlux SA and are legally protected, in particular by the regulations on protection of intellectual property rights. Users of the Kanlux Websites only have the right to browse the Kanlux Websites and print or save files with materials placed on these websites for their own personal use, provided that they do not remove from such prints or files information about copyrights and other rights or any other annotations made by Kanlux SA.
(good practice) While using the Kanlux Websites, Users should observe the law and good practices, in particular the name of the Internet community.
(exceeding one's own personal use)Using the Kanlux Websites in a way exceeding personal use is forbidden. Users acknowledge that they have no right to change the content of the Websites, supplement it, combine it with other works, duplicate, distribute or otherwise make available, including transmitting or making available in computer systems and networks or any other ICT systems.
(Trade marks) Trade names, product names or other individualising signs, including graphic ones, placed on the Kanlux Websites and constituting protected trademarks are subject to legal protection, in particular, under the provisions of the Act of 30 June 2000 - Industrial Property Law (i.e. Journal of Laws of 2003, No. 119, item 1117, as amended), and any use thereof may only be made with the prior written consent of the entitled entities.
(security obligation) Users are obliged to secure their devices against computer viruses, self-copying programs, "Trojan horses" and other threats that may occur on the Kanlux Websites or on websites linked to the Kanlux Websites.
(own risk of users) Users who upload materials from the Kanlux Websites or from websites accessible through links from the Kanlux Websites do so at their own risk and responsibility.
(no-response right) Users acknowledge and agree that to the fullest extent permitted by law, Kanlux SA, or any other person making the content of the Kanlux Websites available, is not liable for any direct, indirect or incidental damages resulting from actions taken or abandoned by Kanlux SA in response to messages sent by e-mail or other means by Kanlux Websites' users. In particular, in no case is Kanlux SA liable towards third parties for loss of profits, disruption of business activity, loss of software or other data in the information handling system or in other systems, even if Kanlux SA was informed about the possibility of such damage.
(reliability of information) Information and materials contained on the Kanlux Websites were prepared by Kanlux SA or on its behalf in good faith and on the basis of sources considered to be reliable, however in no case is Kanlux SA responsible for the reliability, accuracy, completeness and timeliness of information and materials published on the Kanlux Websites and does not guarantee that their use on the websites does not violate the rights of third parties. (implied consent to use of the uploaded material) Kanlux SA does not expect Users to transmit confidential or restricted information through the Kanlux Websites. Placing new Terms and Conditions on the Kanlux Websites will be indicated on those Websites every time, and checking the changes is the responsibility of the User. Using Kanlux Websites after placing the amended Terms and Conditions will be unequivocally treated as the User's consent to these changes.
